These Terms of Service ("Terms") govern your access to and use of the Trendly website, mobile application, waitlist, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Service. We may update these Terms from time to time; continued use after changes become effective constitutes acceptance of the updated Terms.
Eligibility and account responsibilities
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian. You must provide accurate account information and keep it current.
You are responsible for safeguarding your credentials and for activity under your account. Notify us promptly of any unauthorized use.
Use of the service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Violate any applicable law or third-party rights
- Upload content you do not have rights to use (including others' photos without permission)
- Upload unlawful, harassing, defamatory, or sexually exploitative content
- Attempt to gain unauthorized access to the Service or its systems
- Reverse engineer, scrape, or misuse the Service except as permitted by law
- Use the Service to distribute malware or spam
- Misrepresent try-on results as guaranteed fit, sizing, or purchase advice
Your content and license
You retain ownership of photos, wardrobe data, outfits, and other content you submit ("User Content"). You grant Trendly a non-exclusive, worldwide license to host, process, reproduce, display, and transmit User Content only as needed to operate, secure, and improve the Service, including AI processing for try-on and recommendations, as described in our Privacy Policy.
If you post public closets or outfits, you grant other users the right to view that content within the Service. You represent that you have all rights necessary to submit User Content and to grant these licenses.
Virtual try-on and AI features
Virtual try-on, style recommendations, and other AI outputs are provided for visualization and inspiration only. Results may be inaccurate or incomplete. Trendly does not guarantee fit, color accuracy, fabric appearance, or suitability for purchase. You are solely responsible for sizing decisions, returns, and purchases with retailers.
The Service is not professional fashion, medical, or legal advice. Do not rely on the Service as the sole basis for important decisions.
Shopping, affiliates, and third parties
The Service may include in-app browsing, product links, or affiliate relationships with retailers. Purchases are made directly with third parties and are subject to their terms, pricing, shipping, and return policies. We are not responsible for third-party products, availability, or fulfillment. We may earn commissions from qualifying purchases where disclosed.
Subscriptions and billing
Some features may require a paid subscription. Fees and plan details will be disclosed before purchase. Unless otherwise stated, payments are processed by third-party payment providers and are non-refundable except where required by law or stated in the offer. You authorize charges to your selected payment method.
Free tiers may include usage limits (for example, a number of try-ons per month). We may change plans, limits, or pricing with notice where required.
Waitlist and early access
Joining a waitlist does not guarantee access, launch timing, or specific perks. Early-access benefits described on our website may change and are offered at our discretion, subject to any additional terms we communicate at launch.
Intellectual property
The Service, including software, design, trademarks, and documentation, is owned by Trendly or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes unless otherwise agreed in writing.
Third-party services
The Service relies on third-party providers (for example, cloud hosting, authentication, analytics, payments, and AI infrastructure). Your use of linked third-party sites is governed by their terms. We are not responsible for third-party services.
Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRENDLY AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
Indemnification
You agree to indemnify and hold harmless Trendly and its affiliates, officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any third-party rights.
Termination
We may suspend or terminate your access at any time for violation of these Terms or as required by law. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive will remain in effect.
Governing law and disputes
These Terms are governed by the laws of the State of Louisiana, United States, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Louisiana, unless applicable law requires otherwise. You and Trendly waive any jury trial to the extent permitted by law.
Changes to these terms
We may revise these Terms by posting an updated version on this page and updating the "Last updated" date. Your continued use after the effective date constitutes acceptance.
